Navigating Success: FIDIC Contract Implementation in Marine Construction Projects

In the world of marine construction, where complexity meets the unrelenting force of nature, the effective management of projects is a vital component of success. The FIDIC (International Federation of Consulting Engineers) Contract, known for its standardization, fairness, and flexibility, has emerged as a reliable framework for implementing large-scale marine construction projects. Let's delve into the nuances of FIDIC contract implementation and explore some sample projects that have harnessed its power.

Understanding FIDIC Contracts:

FIDIC, a global organization dedicated to improving the business and legal environment for the construction industry, offers a range of standardized contracts that provide a clear structure for construction projects. These contracts are designed to balance the interests of all parties involved: the owner, the contractor, and the engineer, ensuring equitable risk distribution and project execution.

Sample Projects Implementing FIDIC Contracts:

  1. Suez Canal Expansion, Egypt:

    • The expansion of the Suez Canal was a colossal project that aimed to widen and deepen the canal, allowing for the passage of larger vessels and increased traffic. FIDIC contracts were employed to manage the intricate network of contractors and subcontractors involved in this historic endeavor. They ensured efficient project delivery, dispute resolution, and adherence to high-quality standards.
  2. Hong Kong-Zhuhai-Macau Bridge, China:

    • The construction of the world's longest sea-crossing bridge, spanning the Pearl River Delta, was a feat of engineering. FIDIC contracts were used to manage multiple packages of the project, each with its unique challenges. They facilitated clear communication, managed variations, and ensured that quality benchmarks were met.
  3. Dubai Harbor, UAE:

    • Dubai's ambitious project to build a new harbor with a cruise terminal, waterfront promenade, and residential buildings on reclaimed land in the Arabian Gulf called for the deployment of FIDIC contracts. They provided the legal and financial framework for the successful coordination of a diverse team of stakeholders, ensuring compliance with environmental regulations and safety standards.
  4. Panama Canal Expansion, Panama:

    • The expansion of the Panama Canal involved the construction of new locks to accommodate larger ships. FIDIC contracts played a crucial role in managing numerous international contractors, ensuring that the project adhered to rigorous safety, quality, and environmental standards.
  5. Chesapeake Bay Bridge-Tunnel, USA:

    • The Chesapeake Bay Bridge-Tunnel is a complex structure that connects the Delmarva Peninsula with Virginia Beach. FIDIC contracts were employed to manage the design and construction phases, ensuring that the project adhered to strict safety and environmental regulations while effectively managing risks associated with challenging marine conditions.

Benefits of FIDIC Contracts in Marine Construction:

  • Clear and Balanced Allocation of Risks: FIDIC contracts provide a transparent framework for risk allocation, protecting the interests of all parties involved.

  • Dispute Resolution: They offer effective mechanisms for dispute resolution, reducing the potential for costly litigation and delays.

  • Quality Assurance: The contracts emphasize the importance of quality and timely delivery, which is crucial in the marine construction industry.

  • Project Management: FIDIC contracts streamline project management, fostering efficient communication and coordination.

  • Flexibility: These contracts can be adapted to suit the unique needs of each project, making them versatile in various marine construction scenarios.

In the realm of marine construction, FIDIC contracts are a beacon of organization and fairness. As demonstrated by the sample projects mentioned above, these contracts have played a pivotal role in successfully navigating the intricacies of large-scale marine construction endeavors, ensuring that they not only meet but often exceed the high standards demanded by such projects. Their flexible nature and commitment to balanced risk allocation make them an invaluable tool for the industry, fostering trust and collaboration among all project stakeholders.

THE IMPORTANCE OF DISPUTE BOARDS IN A PROJECT

Did you ever heard about Dispute Board?

Dispute Board is a party who will manage the dispute or lead each parties in the projects to avoid a dispute during the project execution. Dispute board can be divided become standing Dispute Board or a Dispute Board which hired after or during dispute happening in the project.

Dispute Board is one of the important party in a project especially in the international project. As we know in the international project, barrier language could be a big possible dispute in the future. Each peoples has their own mindset and their own understanding for each case. That is why, it will be more wise if during the planning, execution and closing the projects, Contractor, Consultant and the Employer hired a Dispute Board Party to secure them from any dispute in the future.

Dispute Board member should be independent and doesn't has any interest for a project party. During their contribution, Dispute Board will giving their analysis or advice about the projects in order to keep each parties from any disputes which is not good for the future of project and business development. Probably, several people will think Dispute Board is wasting money, but if you see in the bigger level, avoiding the dispute can be a win win solution for each interested parties in the projects.

Later I will deeply talk about this topic.

See you in my next post.

The Importance of Project Quality Plan

In a big company, they used to have a good system to ensure their product was manufactured and delivered well to the customer. In construction, this kind of system is mostly developed by the company and is adjustable for each project's activity. For example, the Quality Plan in Indonesia and Quality Plan in America or Africa will not be the same. But, basically, the approach of the Quality Plan will develop based on the company business approach.

In this post, I would like to inform you about the main difference between Material Quality Plan and Work Quality Plan for construction projects.

Maybe all of you ever heard about Fail to Plan is equal to Plan to Fail.

These proverbs are true and I ever saw this thing happen in the project. Several projects don't have good management and it's almost failing just because they don't have rigid guidance about their activity. Or, some projects will fail if they don't have a solid approach for their Quality Management System. Before you run a project, it will be wise if you take more time about 3 things first Cost, Time, and Quality. I believe that these three things will be the ultimate NICE (Need, Interest, Concern, and Expectation) for every stakeholder in a project.

In this post, I would like to inform you about the importance of the Project Quality Plan.

In PQP or Project Quality Plan you will understand the flow of quality of the project and values of projects. It means you will know how to reach that objective of the company and in PQP you can get guidance how to deliver your product to meet the customer satisfaction.

For example inside the Project Quality Plan, you can find the Material Quality Plan and Work Quality Plan of a project. Based on these Quality plans you can prepare everything well based on the Project Specification.

RESOLUSI 2022

Thank you.

THE IMPORTANCE OF QUALITY ASSURANCE ENGINEER

Hi everyone...

I would like to write this post in the English version so everyone will understand my point of view.

First of all, let me introduce you to myself. This is a quick introduction so that you will not think I only can talk without a professional background.
I am Yelna Yuristiary and I was a Master student in Project Management in the Civil Engineering Department at University of Indonesia. I finish my bachelor's degree and master's degree in 5 years by fast-track program. After that, I am working as Asst. Engineer for HSE Management System Developer in Jakarta and as researcher mostly for Investment Analysis project for several infrastructures in Indonesia.

After working in Jakarta, I am going to Batam, as the nearest city to Singapore and I was assigned as QA/QC Manager in an Indonesian company. Even I was assigned as QA/QC Manager, I mostly do the plan and supervise the project at that time. Maybe that project value is around 1.2 million USD. I was handling several projects like that and now I am joining a multi-national company that has Head Quarter Office in Singapore.

So, in this posting, I would like to share with you that Quality Assurance Engineer has an important role in a project. I saw some people think Quality Control is the main key in the project because when you went to the site, you will see the person-in-charge there, and mostly they will do some checking and physical work relating to the projects. But, behind that work, actually, a Project Manager needs to understand well what the Quality Assurance Engineer does. Most of them will work with the documentation process and apply Quality Management systems in a company.

Usually, they will check the quality of the site work based on the document, make sure the procedures going well and understand more about the documentation system. Sometimes, the Quality Assurance Engineer who has good knowledge in a project can identify what's wrong on-site because most of them will read the Project Specification more than site people. Because a Quality Assurance Engineer mostly will develop a Material Quality Plan and Work Quality Plan for the site work. It means, they will re-read things multiple times to understand the specification so that people will know well what is the limit of each work they will do on-site.

Thank you.
See you on the next post.
